On March 16, 2018, the principal attorney of our firm, Desmond P. FitzGerald, sued the Department of Homeland Security (DHS), in Federal Court in Boston, because USCIS officers falsified a document from a process in an asylum case. The lawsuit states that a woman who applied for political asylum was ordered to appear before an immigration officer on March 14, 2018. The woman, along with her attorney, appeared before the officer on the date and time indicated. However, when she, under the instruction of her attorney, did not answer some inappropriate questions, the officer ordered her to leave and told her that he would indicate in her file that she had not attended the interview. The next day, the Department of Homeland Security issued a notice stating that she had not attended the scheduled interview.
“An asylum applicant naturally faces numerous obstacles, but when government officers falsify a document from the process, aside from being illegal, it makes it almost impossible to get their asylum case approved,” said attorney Desmond P. FitzGerald of FitzGerald Law Company.
Failing to appear at an interview with immigration officers has very serious consequences for an immigrant, including not being eligible for a work permit and potentially being subject to a removal/deportation process.
On March 29, 2018, there was a preliminary hearing in Federal Court with Judge Saris, and she has ordered the Government to submit its response to the lawsuit no later than April 25, 2018. We will inform you later about how the course of this lawsuit develops.
