On June 26, 2013 the Supreme Court struck down the Defense of Marriage Act (DOMA), a law which prevented the federal government from recognizing same sex marriages.
The Secretary of Homeland Security, Janet Napolitano, announced that the DHS will now permit same sex couples to obtain immigration benefits under the immigration law.
This means that family petitions, derivative employment benefits like a visa or a green card, and many other options will now be available to everyone.
It is expected in the coming month a number of federal courts, including the District of Massachusetts, with pending cases involving this issue will begin to order USCIS to grant immigration benefits immediately.
Our legal firm in Boston, Massachusetts [1] is currently working on one of these cases in Federal Court and we expect a favorable decision shortly.
