Trump Government will not Accept New DACA Applications, Disobeying Federal Court Orders

A hallmark of the United States government has always been the separation of powers between the Judicial, Legislative, and Executive branches. This system was set up with the clear purpose of ensuring that no single branch could overstep its authority, and to keep a balance of powers in our government.

In the past, the Executive branch has obeyed orders issued by federal courts, as it is required to do under the U.S. Constitution and, as it should in order for our democracy to work.

Yesterday, the Trump Administration formally announced that it will reject all initial DACA applications [1], which is directly contrary to the Supreme Court’s decision on June 28, 2020 [2], and an order issued by the U.S. District Court of Maryland on July 17, 2020. Any individuals who have already mailed initial DACA applications to USCIS will have their applications rejected and fees returned.

One thing must be clear: this is an assault on our democracy. No president, or his administration, are above the law, but the Trump Administration has again showed that it has no qualms about ignoring the law. The precedent this sets for future Executive action is frightening. With every decision, such as this one, the Trump Administration shows us that it is more important than ever for our voices to be heard on November 3rd so that we can return our country to a place where the American Dream is more than just a fading whisper, but a boisterous reality.
